User Agreement

This User Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Savohub Technologies, Ltd. ("Company," "we," "us," or "our") and it governs your use of the SavoRide mobile application ("the App"). By downloading, accessing, or using the App, you agree to comply with and be bound by the terms and conditions set forth in this Agreement. If you do not agree with these terms, please do not use the App.

1. Eligibility

  • 1.1. Age Requirement: You must be at least 18 years old to use the App.
  • 1.2. Legal Capacity: You represent and warrant that you have the legal capacity to enter into this Agreement.

2. Account Registration

  • 2.1. Account Creation: To use the App, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
  • 2.2. Account Use: You agree not to share your account with others or use the account of another person without permission. You are responsible for all activities that occur under your account.
  • 2.3. Account Security: You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify us immediately of any unauthorized use of your account.
  • 2.4. Account Updates: You agree to keep your account information up to date and accurate at all times.

3. User Responsibilities

  • 3.1. Accurate Information: You agree to provide accurate, current, and complete information when creating your account and using the App.
  • 3.2. Compliance with Laws: You agree to use the App only for lawful purposes and in a manner that does not infringe on the rights of others and comply with all applicable laws, rules, and regulations when using the App.
  • 3.3. Prohibited Conduct: You agree not to use the App to engage in any illegal, harmful, or fraudulent activities, including but not limited to:
    • Harassment or endangerment of other users.
    • Engagement in any fraudulent or deceptive practices.
    • Impersonation of any person or entity.
    • Interference with the operation of the App or the networks or systems connected to the App.

4. Payment and Fees

  • 4.1. Ride Fees: The cost of rides booked through the App ("Ride Fees") will be displayed before you confirm your ride. By confirming, you agree to pay the Ride Fees as specified.
  • 4.2. Payment Terms: The App may require payment for certain services, including but not limited to rideshare services. You agree to pay all applicable fees as specified within the App.
  • 4.3. Payment Methods: You must provide a valid payment method (credit/debit card or other accepted methods) when booking a ride. You authorize the Company to charge your chosen payment method for the services you use including the Ride Fees and any applicable taxes or fees.
  • 4.4. Refunds: All payments made through the App are final and non-refundable unless otherwise stated, required by law or determined at our sole discretion.

5. Driver and Rider Responsibilities

5.1. Driver Responsibilities

  • Maintain a valid driver's license, insurance (vehicle/rideshare) and vehicle registration.
  • Operate your vehicle in a safe and lawful manner, ensure the safety of riders during ride and comply with all traffic laws and regulations.
  • Provide a clean and well-maintained vehicle.
  • Accept ride requests only when it is safe and appropriate to do so.

5.2. Rider Responsibilities

  • Provide accurate pick-up and drop-off locations.
  • Be ready for pickup at the agreed time and location.
  • Treat drivers and their vehicles with respect.
  • Use seat belts and follow safety instructions during the ride.
  • Confirm the vehicle matches the information displayed to you before boarding.
  • Pay for all rides and any applicable fees.

6. Ratings and Reviews

  • 6.1. User Feedback: After each ride, both drivers and riders have the option to rate and review each other.
  • 6.2. Review Content: Reviews must be honest, accurate, and not contain offensive, defamatory, or inappropriate content.

7. Licenses and Intellectual Property

  • 7.1. License to Use the App: The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for its intended purposes.
  • 7.2. Ownership: All intellectual property rights in the App, including software, content, and trademarks, are owned by the Company or its licensors.

8. Privacy and Data Use

  • 8.1. Privacy Policy: Your use of the App is subject to the Company’s Privacy Policy, which is incorporated into this Agreement by reference.
  • 8.2. Data Collection: The Company may collect, use, and share your personal information as described in the Privacy Policy.
  • 8.3. Consent: By using the App, you consent to the collection and use of your data as outlined in our Privacy Policy.

9. Dispute Resolution

  • 9.1. Governing Law: This Agreement is governed by the laws of Texas State, United State of America.
  • 9.2. Arbitration: Any disputes arising out of or relating to this Agreement will be resolved through binding arbitration, unless prohibited by applicable law.
  • 9.3. Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in a class action or class-wide arbitration.

10. Termination

  • 10.1. Termination by User: You may terminate your account at any time by following the instructions in the App.
  • 10.2. Termination by the Company: The Company may suspend or terminate your account or access to the App at any time, with or without cause, and without notice.

11. Disclaimer of Warranties

  • 11.1. No Warranty: The App is provided "as is" and "as available," without warranties of any kind, either express or implied.
  • 11.2. Limitation of Liability: The Company is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

12. Indemnification

12.1. You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, your violation of this Agreement, or your violation of any third-party rights.

13. Modifications to the Agreement

13.1. Changes to Terms: The Company reserves the right to modify this Agreement at any time. You will be notified of any material changes through the App. Your continued use of the App following such changes constitutes your acceptance of the new terms.

14. Miscellaneous

  • 14.1. Entire Agreement: This Agreement constitutes the entire agreement between you and the Company regarding the use of the App.
  • 14.2. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • 14.3. Waiver: The Company’s failure to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

15. RIDE CANCELLATION POLICY

15.1 Rider Cancellation Policy

  • Free Cancellation Window: Riders can cancel a ride without penalty within 5 minutes of booking, as long as the driver has not yet arrived at the pick-up location.
  • Cancellation Fees: A cancellation fee will be charged if:
    • The ride is canceled more than 5 minutes after booking and the driver is en route.
    • The driver has already arrived at the pick-up location, and the riders cancels or does not show up within 5 minutes.
    Fee Amount: The fee is typically a flat rate, but may vary based on factors such as location, time, and demand.
  • No-Show Policy: If the driver arrives at the pick-up location and the riders does not arrive or communicate within 5 minutes, the ride will be canceled, and a no-show fee will be charged. No-Show Fee: This is equivalent to the minimum fare for the ride.
  • Repeated Cancellations: Riders who repeatedly cancel rides may face temporary suspension of their SavoRide account. Notification will be given if a pattern of cancellations is identified, with potential actions outlined.

15.2 Driver Cancellation Policy

  • Driver-Initiated Cancellations: Drivers are encouraged to accept all rides, but they may cancel a ride under the following conditions:
    • The rider’s pick-up location is deemed unsafe or inaccessible.
    • The rider does not arrive within 5 minutes after the driver’s arrival.
    • The rider is acting in a way that makes the driver feel unsafe.
    Rider Refunds: If a driver cancels under these conditions, the rider will not be charged a cancellation fee.
  • Driver Accountability: Drivers who cancel rides frequently may face penalties, including reduced priority for ride assignments or temporary suspension. SavoRide monitors cancellation rates and will take action if a driver’s cancellation rate exceeds an acceptable threshold.
  • Cancellation by SavoRide: In rare cases, SavoRide may cancel a ride due to unforeseen circumstances (e.g., system errors, safety concerns). Riders will be notified immediately and will not be charged a fee.

15.3 Refunds and Disputes

  • Requesting a Refund: Riders who believe they were unfairly charged a cancellation or no-show fee can request a refund through the SavoRide app within 24 hours of the charge. Each request will be reviewed on a case-by-case basis, and a decision will be communicated within 48 hours.
  • Dispute Resolution: If there is a disagreement regarding a cancellation fee, SavoRide’s customer support team will mediate between the driver and the rider to reach a fair resolution. In cases where the dispute cannot be resolved, SavoRide reserves the right to make the final decision.

15.4 Policy Updates

SavoRide reserves the right to update or modify this cancellation policy at any time. Any changes will be communicated to users through the app and via email, and the updated policy will take effect immediately upon notification.
